Quetta. July 28: A two-member bench of Balochistan High Court comprising Justice Muhammad Kamran Khan Malakhil and Justice Iqbal Ahmed Kasi heard the constitutional petition filed by Naeem Khan on behalf of Deputy Commissioner Quetta and others.
During the hearing, the learned counsel for the petitioner, Bahlul Khan Kasi, has submitted a report regarding the ownership of the pending cases, which has shown twelve persons and further stated that in compliance with the court order, the housing scheme of the petitioner has been transferred. Staff are reviving old cases and investigating these cases. In which more than 60 percent payments have been made. However, some persons present in the court pointed out that they have already paid 100 per cent, but so far they have neither been given possession nor provided the necessary ownership certificate. Similarly, some others are complaining that the concerned official of the petitioner’s office was not available, hence their cases are still pending.
In response to which the counsel for the petitioner has said that all those who have already paid more than 60% will be adjusted accordingly. As directed by the court. However, it is said that the demarcation process is not yet complete. The learned Additional Attorney General seeks an opportunity to inquire the concerned Revenue authorities about the pending limitation proceedings. The petitioner’s counsel added that the cases of some persons with less than 60% payments were also considered by the administration and if their purchased plots were not further sold to others, their cases were also considered, but priority was given to them. will be given to those who have made 100% payments or those with more than 60% payments as directed by the court.
The Hon’ble two-judge bench directed the counsel for the petitioner to compel Mr. Shark to accompany all the persons present in the court for redressal of his grievance. A copy of this order may be sent to the counsel for the petitioner and the learned Additional Advocate General for information and compliance.
